Operator: Tide Turner Learning Inc.

A note to parents (summary)

Wealthii Kids is a learning app for children aged 8–12, set up and controlled by a parent or guardian. You, the adult, are the account holder and agree to these Terms on behalf of your household. Your child plays under a profile you create and supervise. The app teaches money concepts through a cozy "dragon sanctuary" game. In-game "gems" are earned by learning and are never sold. The only purchase is an optional subscription that unlocks more learning content. This summary is for convenience; the full Terms below govern.

1. Who these terms are between, and acceptance

These Terms of Service ("Terms") are a binding agreement between you, the parent or legal guardian who creates and controls the account ("you"), and Tide Turner Learning Inc. ("we," "us," or "our"), governing the Wealthii Kids mobile app and related services (the "Service").

By creating an account, downloading, or using the Service, you confirm that you are at least 18 years old (or the age of majority where you live), that you are the parent or legal guardian of the child who will use the Service, and that you agree to these Terms and to our Privacy Policy on your own behalf and on behalf of your child. If you do not agree, do not use the Service.

We may update these Terms from time to time. For material changes we will provide notice (for example, in the app or by email to the parent). Continued use after a change takes effect means you accept the updated Terms.

2. The account model (parent-owned)

The Service uses a parent-owned account model:

  • You are the only account holder and the only authenticated user. You sign in; your child does not have a login or credentials.
  • Your child uses a profile you create beneath your account, under your supervision. On the free tier, you may create one child profile and access the introductory Ember Hearth learning content. A paid Single subscription retains the one-child limit and unlocks all learning content; a paid Family subscription allows up to six child profiles with full content access, as described in Section 5.
  • You are responsible for keeping your login credentials and parent PIN confidential, for the activity under your account, and for supervising your child's use of the Service. Notify us promptly at help@tideturnerlearning.com if you believe your account has been used without your permission.

3. What the Service is

Wealthii Kids helps children build early money skills through:

  • interactive financial-literacy lessons and activities;
  • a "dragon sanctuary" your child grows by earning and spending in-app gems; and
  • progress tracking, learning milestones, and gentle goal-setting.

The Service is educational only. It is not financial, investment, tax, or legal advice, and it is not a substitute for professional guidance. We may update, change, or discontinue features at any time.

There are no social features and no user-generated content. Children cannot post, message, chat, or share free-text content through the Service.

4. In-app currency ("gems")

Gems are a virtual, in-app item with no real-world value. They exist only inside the Service.

  • Gems are earned by learning. Gems are never sold, and cannot be purchased with money or otherwise acquired outside the app's learning activities. There is no purchasable currency and no consumable in-app purchase of any kind.
  • Gems are non-transferable and cannot be exchanged, redeemed, or cashed out.
  • We may adjust how gems are earned or spent within the app over time as we improve the learning experience.

5. Subscriptions and billing

The Service offers a free tier and optional paid subscriptions.

  • Free tier. You can create one child profile and access the introductory Ember Hearth learning content at no charge, with all gameplay mechanics (experience points, gems, and streaks) fully available. Other learning biomes are locked until you subscribe. Free features may change at our discretion.
  • Paid subscriptions. The Single plan keeps the one-child limit and unlocks all learning content; the Family plan allows up to six child profiles with full content access. A free trial may be offered on a paid plan at the point of purchase. Subscription tiers and prices are displayed in-app at the point of purchase and within your app store account settings.
  • Payments are processed by the app stores. All purchases are made through the Apple App Store or Google Play (managed via RevenueCat) and are governed by that store's terms and payment rules in addition to these Terms. We do not collect or store your payment card details.
  • Auto-renewal. Subscriptions renew automatically through the app store until you cancel. You can cancel anytime through your app-store account settings; cancellation takes effect at the end of the current billing period.
  • Price changes. If a subscription price changes, the store will handle notice and any required consent in accordance with its rules and applicable law.
  • Refunds. Subscriptions and billing are managed directly by the Apple App Store or Google Play. Refund requests must be submitted through your app store account in accordance with that platform's refund policies. Nothing in these Terms limits any statutory withdrawal or consumer refund rights you may have under local law (including Quebec consumer-protection rules or EU/UK withdrawal rights).
  • What lapsing does and does not do. If a subscription lapses, your child's existing profiles and progress are not deleted. Access to paid content is re-locked, and creating additional child profiles is paused, until you resubscribe.

6. Acceptable use

You agree not to, and not to allow anyone to: copy, resell, or redistribute the Service or its content; reverse engineer or interfere with the Service; attempt to access non-public areas or other users' data; misuse the Service in violation of law; or use the Service other than for your household's personal, non-commercial use. You are responsible for your and your child's use of the Service.

7. Our content and your license to use it

All content in the Service (including lessons, characters, artwork, graphics, audio, software, design, and the look and feel) is owned by us or our licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your household's personal, non-commercial use. You receive no other rights.

Because the Service has no user-generated content, no user-content license is granted to us.

Copyright notices. If you believe that any content in the Service infringes your copyright, please send a notice to our copyright agent at copyright@tideturnerlearning.com, with enough detail to identify the copyrighted work and the material you are concerned about so we can review and respond.

8. Educational disclaimer

The Service provides educational content only. It is not personalized financial, investment, tax, or legal advice; it does not recommend specific financial products; and it makes no guarantees about learning outcomes. It does not connect to real bank accounts. Always consult a qualified professional for financial decisions. Tide Turner Learning Inc. is not a registered financial advisor, broker, dealer, or investment company.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, Tide Turner Learning Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. To the extent permitted by law, our total liability for any claim arising from or relating to the Service is limited to the greater of $100 CAD or the amount you paid us in the 12 months preceding the claim.

Some jurisdictions (such as Quebec) do not allow limitations on statutory warranties or certain types of damages; if those laws apply to you, these limitations apply to the maximum extent permitted by law. Nothing in these Terms limits any rights you have under mandatory consumer-protection law that cannot be waived.

10. Indemnification

You agree to defend, indemnify, and hold harmless Tide Turner Learning Inc. from and against any third-party claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your or your child's material breach of these Terms or misuse of the Service.

Note for Quebec / consumer users: This section applies only to the extent permitted by the mandatory consumer-protection laws of your jurisdiction.

11. Termination

You may stop using the Service and delete your account at any time from the parent area of the app or by contacting us. We may suspend or terminate access if you materially breach these Terms or as required by law. On deletion, we handle your child's information as described in the Privacy Policy. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

12. App store terms

You acknowledge these Terms are between you and us, not with Apple or Google. If you obtained the app from the Apple App Store, Apple is not responsible for the Service and is a third-party beneficiary entitled to enforce these Terms against you; if from Google Play, Google is not a party to these Terms. Each store's own terms also apply to your download and purchases.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable there, without regard to conflict-of-laws principles.

Informal resolution first. Before bringing any formal claim, please contact us at help@tideturnerlearning.com so we can try to resolve it informally. We ask that you give us a 30-day period from the date of that notice to work toward a resolution before starting any formal proceeding.

Courts. If we cannot resolve a dispute informally, it will be subject to the exclusive jurisdiction of the courts of Newfoundland and Labrador, and you and we submit to that jurisdiction, except where applicable law entitles you to bring proceedings in the courts of your own province or country.

Consumer protection. Nothing in these Terms excludes or limits consumer rights that cannot be excluded under applicable law. If you are in Quebec, Quebec's Consumer Protection Act and Law 25 may give you additional, non-waivable rights, which prevail over any conflicting term to the extent required by law. Similar protections may apply in Ontario, the EU/UK, and elsewhere.

14. General

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign yours without our consent. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. We may provide notices in the app or by email, and you may send notices to us at help@tideturnerlearning.com.

By using Wealthii Kids, you confirm you have read, understood, and agree to these Terms on your own behalf and on behalf of your child.
